There seems to be major issue in the case of United States v. Viktor Kozenzy. The specific legal question is whether Viktor Kozenzy, Frederic Bourke, Jr, and David Pinkerton had conspiracy to violate the Foreign Corrupt Practices Act and the Travel Act. There are many facts that support this claim. Viktor Kozenzy, Federic Bourke Jr. and David Pinkerton paid and also caused to be paid bribes to Azeri Officials. They all became shareholders of Oily Rock. Oily Rock invested in Azeri privatization vouchers. They also became part of Minaret as well. Mineret was a party to the co-investment agreement between Oily Rock and the co-investors. There seems to be lots of more facts in this case. The defendants made many corrupt payments, promises, and offers to Senior officials of the Government of Azerbaijan. They all seemed to have conspiracy to bribe and there are evidence of wire transfers and direct cash payments. They also promised two-thirds of the profits of Oily-Rock and receive two-thirds of Oily Rock vouchers. There are was also much jewelry exchanged in excess of $600,000 to Azeri officials. The source of my facts came from Justice.gov, it is the official United States Department of Justice’s website. It is very credible and accurate. There seems to be relevant laws and regulations such as Foreign Corrupt Practices Act and Travel Act. The Foreign Corrupt Practices Act made it unlawful to bribe officials. It was passed in 1977. I believe that the court reached the decision by the substantial evidence. There were documented evidence that shows the money laundering, stock options, and wire transfer to foreign officials. I think that the court was correct that the defendant did indeed conspire to violate the Foreign Corrupt Practices Act and the Travel Act. This situation could be easily avoided if the government officials had personal watching over them or checking the bank accounts. Many of the officials should be watched closely after and monitored. This source tells us that they weren’t fighting soldiers which we can say is true because if all the suggestions above are true, we can truly conclude that the soldiers weren’t ready to fight. Thomas Kerr goes on to say â€Å"There were hardly any officers, and the few present were useless†- this implies that there were hardly any officers left because they could have been killed or captured during the evacuation, and for the ones that were their they were probably so taken aback by the events going on that they could no longer instruct. It could also tell us that the officers there were tired or injured, so they couldn’t do much. This could be biased because Thomas Kerr could be trying to make us think that the officers were useless to try and make him or other naval commanders look good. Thomas Kerr then says â€Å"but our promise of safety, and the sight of our naval uniforms, resorted some order to the rabbleâ€Å"- this tells us that the navy was promising the soldiers safety and that their ‘glorious’ uniforms resorted some order to the rabble, this can be seen as biased because Thomas Kerr is making us think that the navy was powerful and saying it as if though the navy were the leaders, he himself is a part of the navy and just wants to make them look superior and heroic. Thomas Kerr lastly says â€Å"Their faith in the navy was pathetic; we could only do our best.†- this suggests that the soldiers didn’t really believe in the navy that they thought of them as they did everyone else, it then suggests that they could only do their best. There are two main parts in this project. first one is the pre-feasibility study and second is feasibility study. In the first part I have analyzed the scenario in the sector and market potential. In the second part I have tried to cover the financially related aspects of the project. The minimum delivery time required is three months, if ordered through an internet vendor. There are also re-conditioned machines available in the market. Some outlets, before closing their business sell their machinery at low cost. Maintenance of machinery is very important for maximum quality and long life of the equipment. The machine requires routine cleaning, maintenance and annual service. We will use new machinery with latest technology in our project. This would help us in producing good quality food products, high efficiency, low labor and operating cost and would reduce human errors. The machinery required for the plant is easily available in local market, so all the purchases will be done locally. Local purchases would help us in clams of default piece, would prevent us from high transportation costs and government taxes and would reduce our time to start the project. In the distribution of land for different areas in a restaurant, it is recommended that the largest part should be donated to the dining hall and second preference should be given to kitchen. The land requirement in our project is 4475 sq.ft. The area should be populated and should have proper utilities and facilities. The construction cost totally depends on the size of land the amount of work to be done on it. In our project the construction requirement in different parts of the restaurant is different. For example construction cost for kids playing area would be lower than construction cost for waiting area, as less has to be done in waiting area as compared to dining area. Location The location chosen for the required project is JOHER TOWN MAIN BUALIVORD.The traffic of potential costumer is maximum there .the construction of micro shopping mall and Pakistan trade center would bring a huge wave of potential costumers Rent The rent at Johet Town Main Boulevard for a double storied building is 125,000 per month. Plant capacity The area required for this restaurant is 4500 sq feet. The seating arraignment is for 100 people. There are 25 dieing tables, and four people can sit on one table. The total management in the restaurant comprises of 23 people. Ten people can be seated at the waiting lung. Hence in total, the restaurant can shelter up-to 130 to 140 at a time. Utilities Assumptions Rent increases by 5% after every year. Salaries increase by 2% after every year. Residual value is zero. Capital utilization differs in four years, and remains constant afterwards. Debt-equity ratio is 50-50. Straight-line method is used for depreciation. Current interest rate is 20%.. Tax rate is 20%.. 150 people visit the restaurant every day. Average purchase amounts RS.120. Do-ability of the project The proposed project can show high returns. the project perfectly sets to the changing patterns of the country. If the gets good reorganization among its potential costumers, the project can show amazing result, and can prove a good investment for the investor. Comparative advantage As the demand for fast-food increases, the prices increase with it. The only comparative advantage is that, the owner will offer low prices to the costumers. This would increase its sales. ACCABILITY OF THE PROJECT As shown, that the NPVs and IRRs calculated above are negative in most of the cases, except the resource statement. This shows that the project is not acceptable. On the other hand if the revenues assumed above are increased, the returns will increase, and thus will end up with positive NPV. However, as times and generations have passed, the U.S. Constitution remains the supreme law of the land. Among the most contemporary and controversial elements are the challenges of evolving interpretations of the freedom of speech, and search warrants, which have both had a major impact on society. In particular, we explore speech not protected by the First Amendment of the Constitution, as well as some circumstances when a search warrant is not required for a valid search. A conclusion is drawn and outlined based on research conducted to offer a concise in-depth observation of the above topics. FIRST AMENDMENT FREEDOMS The First (1st) Amendment of the United States (U.S.) Constitution, ratified December 15, 1791, â€Å"guarantees to all Americans regardless of age, ethnicity, disability, faith, or gender, the freedom of speech, freedom of press, the right to assemble, the right to peacefully assemble, and the right to petition Congress (Government) for a redress of grievances† (Kanovitz, 2010). John Steinbeck's The Grapes of Wrath Throughout his book, the Grapes of Wrath, John Steinbeck employs the principles of Foucault’s theory that power exists as a result of consent. This is particularly the case in the relations between the Joad family. Chapter ten includes specific scenes in which the family members’ assumed positions of power are focused on and explained. When Jim Casy asks if he can accompany the Joads on their migratory trip to California, Ma looks to Tom to speak, â€Å"because he [is] a man†. Ma is clearly consenting to Tom’s power over her as a male figure, not because he told her he had the right to speak first, but because she allowed him to hold that prerogative. Foucault also argues that identity perception is related to various modes of discourse that are specific to historical eras; apparently, the idea that women are subordinate to men has been established in behavior, media, or any other entity that influences the way people think. When the rest of the Joad family returns on the truck after attempting to sell the last of their belongings, Steinbeck uses three pages to describe each family member’s place on the truck and why they belong there. Al is the â€Å"proud and serious and efficient† driver of the truck, earning the family’s respect for his responsibility in manning the vehicle. This exemplifies Foucault’s idea of transaction: the family consents to Al’s power because they will be affected if the truck malfunctions. Before this unfortunate transformation occurred, Gregor did not have the best relations with his family. Gregor did in fact care for his sister so much that he wanted to sent her to study at the Conservatorium, even though it would cost him greatly. But despite these good intentions, Gregor's mother and father frowned upon such ideas. Gregor also was not aware of his family's true financial status, which is iron since he was the one providing for them. His parents seemed to be keeping something from him. Gregor's separation from his family also had to do with his work. Air and water Pollution Introduction The earth is constantly working hard to repair itself for man made pollution such as carbon monoxide, nitric oxide, sulfur oxides, volatile organic compounds and particulate matter. All of the above named pollutants are what is known as primary pollutions; the main reason that they are called primary pollutions is because they are directly released into the earth’s atmosphere and it has adverse affects on everything such as the uman anatomy, the reservoirs as well as animals and even the way major cities sky’s look. But the main things that will be discussed and analyzed are black carbon pollution and smog. The other matters that will be addressed is two types of water pollution such as, Oil spills and trash being dumped into oceans. Black Carbon Pollution According to  lbl. gov  (n. d. ),  Ã¢â ‚¬  Black carbon pollution is the release of tiny particles into the air from burning fuel for energy. Air pollution caused by such particulates has been a major problem since the beginning of the industrial revolution and the development of the internal combustion engine . Scientific publications dealing with the analysis of soot and smoke date back as early as 1896. Mankind has become so dependent on the burning of fossil fuels (petroleum products, coal, and natural gas) that the sum total of all combustion-related emissions now constitutes a serious and widespread problem, not only to human health, but also to the entire global environment. †Ã‚  (Why study black carbon pollution,  para. 1). This type of pollution is called primary pollution, because of the fact that the toxins from the fuel are released directly into the air. The adverse affects on humans from back carbon pollution can be asthma, and acute allergies. Black carbon pollution plays a major role in global warming â€Å"Scripps Institution of Oceanography at UC San Diego atmospheric scientist V. Ramanathan and University of Iowa chemical engineer Greg Carmichael, said that soot and other forms of black carbon could have as much as 60 percent of the current global warming effect of carbon dioxide, more than that of any greenhouse gas besides CO2. † (University of California – San Diego,  2008, para. 2). Smog pollution A smog (2010), according to Smog-Definition, A form of air pollution produced by the photochemical reaction of sunlight with hydrocarbons and nitrogen oxides that have been released into the atmosphere, especially by automotive emissions. Most smog in the world come from industrial plants such as power plants and emotions from cars. This type of pollutions is also called primary pollution as well. Smog effects the atmosphere in such a harsh way and causes things such as acid rain. Which destroys plants and some of the world water supplies and this is a very harmful. Smog also contributes to the overcast in some major cities such as New York, Los Angeles and all other major cities. This affects not only American cities but countries outside of the United States of America. Basically smog can be anywhere any major city is. Water Pollution Pollution is the world water way and water supplies is an ongoing problem because of a various reasons but some of the major reason are, oil drilling. Oil is one of the world natural resources and a great majority of it is found in oceans around the world. Now oil is a resources that is needed in society today but, it is also destroying ocean life and causing clean and fresh water to be continually contaminated.
